Terms and Conditions & Privacy Policy

1. Introduction
These Terms and Conditions (“Terms”) and Privacy Policy govern your access to and use of the websites www.kimalbe.com and www.kima-academy.com (collectively, the “Websites”), as well as any programs, courses, workshops, learning management system (“LMS”), content, and services offered by KIMA LBE Ltd. (“KIMA,” “KIMA Academy,” “we,” “us,” or “our”), a company incorporated under the laws of the State of Israel.
By accessing or using our Websites, registering for any KIMA Academy program, or accessing the LMS, you (“User,” “Participant,” “you”) acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not access or use our services.
You must be at least 18 years of age to register for or participate in any KIMA Academy program or service.
2. About KIMA Academy
KIMA LBE Ltd. is a venture creation firm focused on the human asset, specializing in accelerating leadership and C-level potential. KIMA Academy designs and delivers professional development programs for various levels of professional elevation, including lectures, workshops, video-based learning, coaching sessions, and other educational activities (collectively, “Programs”).
3. Account Registration & LMS Access
Access to certain content and Programs requires registration on the KIMA Academy LMS. Upon enrollment, you will receive a unique username and password. You are solely responsible for:
Maintaining the confidentiality of your login credentials.
All activities that occur under your account.
Notifying KIMA immediately at [email protected] of any unauthorized use of your account or any other security breach.
KIMA reserves the right to suspend or terminate your account at its sole discretion if it suspects unauthorized access, misuse, or any breach of these Terms.
4. Intellectual Property Rights
4.1 Ownership
All content, materials, curricula, methodologies, frameworks, slides, presentations, handouts, recordings, videos, audio files, written materials, case studies, exercises, assessments, tools, templates, and any other materials provided as part of any KIMA Academy Program or made available through the Websites or LMS (collectively, “KIMA Materials”) are the sole and exclusive intellectual property of KIMA LBE Ltd.
KIMA Materials are protected by Israeli and international copyright, trademark, and other intellectual property laws. All rights not expressly granted herein are reserved by KIMA.
4.2 Limited License
KIMA grants you a limited, non-exclusive, non-transferable, revocable license to access and view KIMA Materials solely for your personal, non-commercial, educational use in connection with your participation in a KIMA Academy Program. This license does not include the right to:
Copy, reproduce, duplicate, or download any KIMA Materials in whole or in part, except as expressly permitted.
Distribute, share, transfer, publish, broadcast, or otherwise make available any KIMA Materials to any third party, including but not limited to colleagues, employers, or competitors.
Modify, adapt, translate, create derivative works from, reverse-engineer, or decompile any KIMA Materials.
Use any KIMA Materials for commercial purposes, training, consulting, or any purpose other than your personal learning.
Record, screenshot, photograph, or otherwise capture any live or recorded session, lecture, or workshop, unless expressly authorized in writing by KIMA.
4.3 Participant-Generated Content
To the extent that you submit, share, or contribute any content, materials, ideas, feedback, or intellectual contributions during a KIMA Academy Program (including but not limited to case studies, written assignments, project work, group exercises, or forum posts) (“Participant Content”), you hereby grant KIMA a perpetual, irrevocable, worldwide, royalty-free, non-exclusive license to use, reproduce, modify, adapt, publish, and distribute such Participant Content for the purposes of improving, marketing, and delivering KIMA Programs. KIMA will make reasonable efforts to anonymize any Participant Content before use outside of the specific Program in which it was generated.
5. Confidentiality & Non-Disclosure
5.1 Confidential Information
During KIMA Academy Programs, participants may share personal experiences, professional challenges, business scenarios, strategies, proprietary information, and other sensitive content (“Confidential Discussions”). You acknowledge and agree that:
All Confidential Discussions shared by any participant during any Program session (whether live, recorded, or in any forum) are strictly confidential.
You shall not disclose, discuss, share, reproduce, or reference any Confidential Discussions or the identity of any participant in connection with such discussions to any person or entity outside of the specific Program session in which they were shared.
This obligation of confidentiality survives the termination or completion of any Program and continues indefinitely.
Any breach of this confidentiality obligation may result in immediate termination from the Program without refund, as well as legal action for damages.
5.2 Recordings
Certain KIMA Academy sessions may be recorded (video and/or audio) for educational purposes. By participating in any Program, you acknowledge and consent to the following:
KIMA may record sessions in which you appear, speak, or otherwise participate.
All recordings are the exclusive property of KIMA LBE Ltd.
Recordings may be made available to other KIMA Academy users through the LMS for educational purposes.
You shall not record, capture, download, copy, or redistribute any session recordings.
KIMA will inform participants prior to any recording taking place and will obtain explicit consent.
5.3 Non-Compete on Content
You agree not to use any knowledge, methodologies, frameworks, or content obtained through KIMA Academy Programs to create, develop, or deliver competing programs, courses, training, workshops, or educational materials without the prior written consent of KIMA.
6. Payments, Refunds & Cancellations
6.1 Fees
Program fees vary depending on the specific Program and are communicated prior to enrollment. Fees may be paid by individual participants or by their sponsoring employers or organizations, as agreed upon during the enrollment process. All fees are quoted in the currency specified at the time of enrollment.
6.2 Payment Processing
KIMA may, from time to time, offer online payment processing through third-party payment providers. When such services are available, your payment information will be processed directly by the third-party provider and will be subject to their terms and privacy policies. KIMA does not store credit card or bank account details on its servers.
6.3 Refund & Cancellation Policy
Refund and cancellation terms are specific to each Program and will be communicated at the time of enrollment. Unless otherwise stated:
Full refund is available if cancellation is made at least 14 days before the Program start date.
50% refund is available if cancellation is made between 7 and 14 days before the Program start date.
No refund is available for cancellations made fewer than 7 days before the Program start date or after the Program has commenced.
KIMA reserves the right to cancel or reschedule any Program at its discretion, in which case a full refund or credit will be offered.
7. User Conduct
As a participant in KIMA Academy Programs, you agree to:
Treat all participants, facilitators, and KIMA staff with respect and professionalism.
Not engage in any behavior that is disruptive, harassing, discriminatory, or offensive.
Not use any KIMA platform, LMS, or communication channel for purposes unrelated to the Program.
Not attempt to gain unauthorized access to any KIMA system, account, or data.
Comply with all applicable laws and regulations in connection with your use of KIMA services.
KIMA reserves the right to remove any participant from a Program and/or suspend or terminate their access to the LMS and Websites for violation of these Terms, without refund.
8. Disclaimers & Limitation of Liability
8.1 No Guarantee of Results
KIMA Academy Programs are designed to provide professional development education and leadership training. KIMA does not guarantee any specific outcomes, results, career advancement, business success, or return on investment from participation in any Program.
8.2 Limitation of Liability
To the maximum extent permitted by applicable law, KIMA LBE Ltd., its directors, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with your use of the Websites, LMS, or participation in any Program.
KIMA’s total aggregate liability for any claims arising from these Terms or your use of KIMA services shall not exceed the amount of fees you paid for the specific Program giving rise to the claim.
8.3 Website Availability
The Websites and LMS are provided on an “as is” and “as available” basis. KIMA does not warrant that the Websites or LMS will be uninterrupted, error-free, or free of viruses or other harmful components. KIMA reserves the right to modify, suspend, or discontinue any aspect of its services at any time without notice.
9. Cookies & Tracking Technologies
KIMA may use cookies, web beacons, pixels, and similar tracking technologies on the Websites and LMS to:
Ensure proper functionality and user authentication.
Analyze website usage patterns and improve our services.
Deliver relevant content and track Program engagement.
Support marketing and advertising efforts, if applicable.
By using the Websites, you consent to the use of cookies in accordance with this policy. You may manage your cookie preferences through your browser settings; however, disabling certain cookies may affect the functionality of the Websites and LMS.
Where third-party analytics or advertising tools are used, their respective privacy policies will apply to the data they collect.

10. Information We Collect
10.1 Personal Information You Provide
When you register for a KIMA Academy Program, create an LMS account, or interact with our Websites, we may collect the following personal information:
Full name
Email address
Phone number
Job title and role
Company or organization name
Payment information (processed by third-party payment providers when applicable)
Professional background and experience (as provided during registration or Programs)
Any other information you voluntarily provide during enrollment or participation
10.2 Information Collected Automatically
When you visit our Websites or use the LMS, we may automatically collect:
IP address and approximate location
Browser type and version
Device information (operating system, screen resolution)
Pages visited, time spent, and navigation patterns
Referring website or source
LMS usage data (course progress, video views, assessment completions)
10.3 Recordings and Media
As described in Section 5.2, KIMA may record Program sessions. These recordings may contain your image, voice, and contributions. Such recordings are collected with your prior consent.
11. How We Use Your Information
We use the personal information we collect for the following purposes:
To process your enrollment and manage your participation in Programs.
To provide access to the LMS and deliver Program content.
To communicate with you regarding Programs, schedules, updates, and administrative matters.
To process payments and manage billing (where applicable).
To improve our Programs, Websites, and services.
To analyze usage trends and optimize user experience.
To comply with legal obligations under Israeli law.
To send you marketing communications about future KIMA Programs and services (you may opt out at any time).
To protect the rights, property, and safety of KIMA and its users.
12. How We Share Your Information
KIMA does not sell, rent, or trade your personal information to third parties. We may share your information in the following limited circumstances:
With third-party service providers who assist us in operating the Websites, LMS, and payment processing, subject to their obligation to protect your data.
With your employer or sponsoring organization, limited to enrollment confirmation, attendance, and Program completion status, where they are sponsoring your participation.
When required by law, regulation, legal process, or governmental request.
To protect the rights, property, or safety of KIMA, its users, or the public.
In connection with a merger, acquisition, or sale of all or part of KIMA’s assets, with appropriate notice.
13. Data Security
KIMA implements appropriate technical and organizational measures to protect your personal information against unauthorized access, alteration, disclosure, or destruction. These measures include, but are not limited to:
Encrypted data transmission (SSL/TLS) on our Websites and LMS.
Secure password-protected access to the LMS.
Restricted access to personal information on a need-to-know basis among KIMA staff.
Regular review and update of security practices.
While we strive to protect your data, no method of transmission over the Internet or electronic storage is 100% secure. KIMA cannot guarantee absolute security of your information.
14. Data Retention
We retain your personal information for as long as necessary to fulfill the purposes described in these Terms and Privacy Policy, or as required by law. Specifically:
Account and enrollment data is retained for the duration of your active participation and for a period of 5 years thereafter for record-keeping and legal compliance.
Session recordings are retained indefinitely as part of KIMA’s educational library, unless you specifically request removal of a recording in which you appear (subject to KIMA’s reasonable ability to do so).
Payment records are retained as required by Israeli tax and commercial law.
You may request deletion of your personal data by contacting [email protected]. KIMA will process such requests in accordance with applicable law, subject to any legal retention obligations.
15. Your Rights
Under applicable Israeli privacy law (Protection of Privacy Law, 5741-1981), you have the right to:
Access your personal information held by KIMA.
Request correction of inaccurate or incomplete data.
Request deletion of your data, subject to legal retention requirements.
Object to or restrict certain processing of your data.
Withdraw consent for marketing communications at any time.
15.1 GDPR Rights (for EU/EEA Participants)

18. Changes to These Terms
KIMA reserves the right to modify or update these Terms and Privacy Policy at any time. Changes will be posted on the Websites with the updated effective date. Your continued use of the Websites, LMS, or KIMA services after any changes constitutes your acceptance of the revised Terms. For material changes, KIMA will make reasonable efforts to notify you via email or through the LMS.
19. Governing Law & Jurisdiction
These Terms and Privacy Policy are governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of laws provisions. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Tel Aviv-Jaffa, Israel.
20. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
21. Entire Agreement
These Terms, together with any Program-specific agreements or NDAs signed by you, constitute the entire agreement between you and KIMA regarding the subject matter herein and supersede all prior or contemporaneous communications, agreements, and understandings.
